A distinguished law firm seeks a Litigation Associate (class of 2023 or later) to join its Business Restructuring and Reorganization practice in New York, NY. The role involves complex commercial litigation, including bankruptcy disputes, liability management, corporate conflicts, and financial restructuring matters.

Key Responsibilities:
In the capacity of Business Restructuring and Reorganization Litigation Associate, you will assume a central role within the firm's renowned restructuring group by engaging in sophisticated disputes that arise from creditor-side matters, debtor, or sponsor-side cases, as well as distressed mergers and acquisitions transactions. Your daily responsibilities will encompass representing major financial institutions in contentious proceedings both within bankruptcy court settings and beyond. You will also manage significant litigation for debtors navigating Chapter 11 cases—prosecuting claims such as preferences or fraudulent transfers—and resolving intricate claims related to plan confirmations. In addition to advising clients on litigation risks associated with various transactions, you will participate comprehensively in every stage of the litigation process from discovery through trial preparation to appeals. By collaborating with experienced colleagues across disciplines, drafting compelling legal documents, conducting detailed research, and maintaining strong client relationships built upon trust and empathy, you will contribute directly to successful outcomes for clients facing complex financial challenges.

  • Represent financial institutions such as hedge funds, collateralized loan obligation managers, and private equity funds in sophisticated disputes arising both within Chapter 11 proceedings and in out-of-court contexts involving debtor-in-possession financing, liability management exercises, inter-creditor issues, collateral disputes, and claim objections.
  • Conduct litigation on behalf of debtors in high-profile Chapter 11 cases by prosecuting claims, including preference actions and fraudulent transfer actions, overseeing complex claims resolution processes, and addressing disputes related to plan confirmation.
  • Advise clients regarding litigation risks associated with both judicial proceedings and extrajudicial transactions, ensuring they are fully apprised of potential outcomes and strategic considerations.
  • Participate actively in all phases of litigation, including discovery procedures, motion practice, trial preparation activities, and appellate work to ensure thorough case management.
  • Engage in distressed mergers and acquisitions litigation arising from asset sales conducted under Section 363 of the Bankruptcy Code or contested takeover attempts involving financially distressed entities.
  • Work closely with colleagues across various practice areas to deliver seamless client service on multifaceted restructuring matters.
  • Draft persuasive legal documents, including pleadings, motions, briefs, and memoranda tailored to complex commercial disputes.
  • Undertake comprehensive legal research to inform case strategy development and provide insightful recommendations to senior attorneys and clients.
  • Maintain current knowledge of relevant statutes, regulations, and industry trends affecting business restructuring and reorganization litigation.
  • Cultivate positive relationships with clients through responsive communication and empathetic understanding of their unique circumstances during periods of financial difficulty.
